These Terms and Conditions ("Terms") govern your use of the Alaska Industrial Academy website, our online training platform(s), and participation in any in-person or virtual courses, programs, or services (collectively, the "Services").
By accessing our website, registering for a course, or participating in any training delivered by Alaska Industrial Academy ("AIA," "we," "us," or "our"), you agree to be bound by these Terms.
If you do not agree to these Terms, do not use our website or Services.
1. Eligibility and Account Responsibilities
1.1 Age and authority
You must be at least 18 years old, or the age of majority in your jurisdiction, or have documented permission from a parent, guardian, or employer to enroll in our courses.
1.2 Account information
Certain Services may require you to create an account directly with AIA or through a third-party platform (such as TalentLMS). You agree to provide accurate and complete information and to keep your login credentials confidential. You are responsible for all activity under your account.
1.3 Employer-sponsored training
If your employer registers you for training, you acknowledge that your employer may receive information regarding your enrollment, progress, and completion status as part of the Service.
2. Nature of Training and No Guarantee of Outcomes
2.1 Educational purposes only
Our courses are provided for educational and informational purposes. Completion of a course does not guarantee:
- Employment, continued employment, promotion, or any specific job assignment;
- Acceptance by a particular operator, facility, or contracting company;
- Compliance with every regulatory requirement that may apply to your specific worksite.
2.2 Employer and worker responsibilities
Employers and workers remain solely responsible for:
- Determining which training, certifications, and qualifications are required for their operations and worksites;
- Implementing appropriate safety programs, supervision, procedures, and controls;
- Complying with all applicable laws, regulations, and client requirements.
Our training does not replace any employer-specific instruction, supervision, site orientation, or hazard assessment.
2.3 CITS, OSHA, and other standards
Unless explicitly stated otherwise on a specific course page:
- Our courses are aligned with OSHA, EPA, AKDEC, CDC, DOT and other referenced standards, but are not official OSHA regulatory interpretations or legal advice.
- CITS (Cook Inlet Training Standards) courses and CITS cards issued by AIA are industry credentials, not OSHA Outreach cards or government licenses.
- OSHA Outreach cards, where offered, are only issued through OSHA-authorized trainers in accordance with OSHA Outreach Training Program requirements.
3. CITS Card and Other Certificates
3.1 Issuance of CITS card
AIA may issue a Cook Inlet Training Standards ("CITS") card upon successful completion of the required CITS training (e.g., CITS HAZWOPER) and satisfaction of any additional requirements we specify.
3.2 Conditions and limitations
We may deny, suspend, or revoke a CITS card or other completion document if:
- You do not meet attendance, participation, assessment, or identity-verification requirements;
- We determine that fraud, misrepresentation, or misconduct has occurred.
3.3 Acceptance by third parties
AIA cannot and does not guarantee that any particular employer, client, contractor, or operator will accept our courses, CITS cards, or certificates. Acceptance and access decisions are made solely by those third parties.
4. Safety, Conduct, and In-Person Training
4.1 Participant conduct
You agree to conduct yourself professionally and safely during all in-person and virtual training. We may remove any participant whose behavior is unsafe, disruptive, or inappropriate, without a refund.
4.2 Compliance with site rules
For training at AIA facilities or at an employer's site, you must follow all posted rules, instructions from instructors, personal protective equipment (PPE) requirements, and site-specific procedures.
4.3 Medical conditions and fitness
Some training may involve physical activities or simulated work tasks. You are responsible for determining, with your medical provider if necessary, whether you are physically able to participate. You must immediately inform the instructor of any condition that could affect your safe participation.
5. Enrollment, Payments, Cancellations, and Refunds
5.1 Payment processing
Many of our online trainings are delivered and paid for through third-party platforms (such as TalentLMS). By enrolling, you also agree to the terms and payment policies of that platform. Where AIA bills you directly, payment terms will be provided at the time of registration or in a separate agreement or invoice.
5.2 Booking and seat reservations
Your seat in a course is not guaranteed until payment is received or a written billing arrangement is confirmed by AIA.
5.3 Cancellations and rescheduling (student)
Our cancellation and rescheduling policies may vary by course and will be published at registration or in your confirmation email. Unless otherwise stated:
- No-shows and late cancellations may forfeit fees.
- Requests to reschedule are subject to availability and may incur administrative fees.
5.4 Cancellations and changes (AIA)
We reserve the right to cancel, reschedule, or modify any course, instructor, date, or delivery format (online vs. in-person) at our discretion, including for low enrollment, instructor illness, weather, or safety concerns. If we cancel a course without offering a reasonable alternative, our liability is limited to a refund of the course fees paid to AIA for that course.
6. Intellectual Property
6.1 Ownership
All course materials, including but not limited to presentations, manuals, handouts, videos, quizzes, logos, and website content are owned by AIA or our licensors and are protected by copyright and other intellectual property laws.
6.2 Limited license for personal use
When you enroll in a course, AIA grants you a limited, non-exclusive, non-transferable license to access and use the course materials for your personal or internal business training only.
6.3 Restrictions
You may not:
- Reproduce, distribute, sell, or publicly display our materials;
- Share your login credentials or allow others to access the course using your account;
- Record, copy, or download course content except where we explicitly allow it.
Any unauthorized use may result in termination of access and legal action.
7. Third-Party Platforms and Links
7.1 Online training platforms
Our online courses may be hosted on third-party platforms (such as TalentLMS or others). AIA is not responsible for the availability, performance, or security of those platforms. Your use of such platforms is governed by their own terms and policies.
7.2 External links
Our website or training may provide links to third-party sites. AIA is not responsible for the content, accuracy, or practices of those sites and does not endorse them.
8. Disclaimers and Limitation of Liability
8.1 No warranties
The website, Services, and all course content are provided "as is" and "as available." To the maximum extent permitted by law, AIA disclaims all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement.
8.2 No guarantee of safety or compliance
Training does not eliminate all risks. You acknowledge that:
- Work in industrial environments involves inherent hazards;
- Safety depends on many factors beyond training, including employer practices, site conditions, equipment, and individual behavior.
AIA does not guarantee that participation in training will prevent incidents, injuries, illnesses, enforcement actions, or regulatory penalties.
8.3 Limitation of liability
To the maximum extent permitted by law, AIA, its owners, employees, instructors, and affiliates will not be liable for any indirect, incidental, consequential, punitive, or special damages, or for loss of profits, business, data, or goodwill arising out of or related to your use of our website or Services.
In all cases, AIA's total liability for any claim arising from or related to the Services will not exceed the amount of course fees actually paid to AIA by you (or your employer on your behalf) for the specific course giving rise to the claim.
8.4 Indemnification
You agree to indemnify and hold harmless AIA, its owners, employees, and instructors from any claims, damages, or expenses (including reasonable attorneys' fees) arising from:
- Your breach of these Terms;
- Your misuse of the Services;
- Your violation of any law, regulation, or third-party rights.
9. Privacy
Our collection and use of personal information is described in our separate Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to our handling of your information as described in that policy.
10. Changes to Courses, Website, and Terms
10.1 Course and site changes
We may update or modify course content, schedules, pricing, and availability at any time.
10.2 Updates to Terms
We may revise these Terms from time to time. The "Last updated" date at the top indicates when changes were last made. Continued use of our website or Services after changes are posted constitutes your acceptance of the revised Terms.
11. Governing Law and Dispute Resolution
11.1 Governing law
These Terms are governed by the laws of the State of Alaska, without regard to its conflict-of-laws principles.
11.2 Venue
Any dispute, claim, or legal action arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Alaska, and you consent to the jurisdiction of those courts.
11.3 Time limit
Any claim you may have arising out of or relating to the Services must be brought within one (1) year after the claim arises, or it is permanently barred, to the fullest extent permitted by law.
12. Miscellaneous
12.1 Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
12.2 No waiver
Our failure to enforce any right or provision of these Terms does not waive that right or provision.
12.3 Entire agreement
These Terms, together with any course-specific terms, signed proposals, or enrollment agreements, and our Privacy Policy, constitute the entire agreement between you and AIA regarding the Services.
